'Plagiarism'
is copying or paraphrasing material without indicating its source.
To plagiarize is "to steal and pass off the ideas and words
of another as one's own".
Where
there's creativity, there's plagiarism. The same goes for the fashion
industry world over. It has never been more important to know how
to protect ones business than in today's world of cut throat competition.
The Indian fashion industry today is fast gaining prominence and
ranks among the high growth sectors of the Indian economy. Thus,
it has become even more important for Indian designers to address
the issue of 'growing plagiarism' which if not addressed timely
would cost the fashion fraternity not only money but a whole lot
more. Though plagiarism has raised its ugly head time and again,
there has never been a concerted effort from the industry players
to counter it.
However,
in the fashion world, in addition to Plagiarism, there also exists
another demon- counterfeiting. This, in simple words, means when
someone not only steals and passes on the designs but the trademark
of another as well, claiming it to be from the genuine source.
Therefore,
for the first time in India, the House of Valaya, the leading and
one of the oldest fashion and design groups of the country is proud
to introduce :
'THE VALAYA DIASUN'.
The
brainchild of two brothers, JJ Valaya and TJ Singh, the Valaya Diasun
is an original pattern, which will be a part of each and every product
manufactured by the design house. Customers will now be able to
differentiate an original Valaya creation from a knock-off by observing
and ensuring the presence of the Diasun incorporated in the collections.
This stamp of authentic innovation will give the House of Valaya,
the right to take legal action against anyone who tries to plagiarize
or counterfeit its designs. Further, customers will now be totally
guaranteed that the Valaya they possess is indeed, an original.
Registered
under the
Copyright Act 1957,
(that shields the work of designers in the country), the Valaya
Diasun is the first such attempt by an Indian design house to protect
his creations and trademarks from being blatantly misused.
Sharing
his thoughts on the launch, JJ Valaya -Creative Director, House
of Valaya said, "It was very important for us to address the
issue of counterfeits and plagiarism. It hurts to see one's originality
being blatantly copied. We had to think of a foolproof way to safeguard
our creativity and brand value. From the Fall-Winter season of 2005,
the Valaya Diasun, a registered original pattern, which will be
an essential part of all our products in various forms ( Linings,
piping and tabs) will give our discerning clients a unsurpassable
assurance and a direct means to identify a genuine Valaya. Any
violation or misuse of this pattern, in any form, will be prosecutable
by law"
Expressing
his views on the initiative, Mr. T J Singh- Business Director, House
of Valaya said, "Though there are laws that protect designs,
designers hardly ever get their works registered. We therefore had
to device a unique methodology which would serve our dual purpose
of protecting both our designs and branding. Today, through the
Valaya Diasun, with the law safeguarding our interest, we can be
rest assured that any person indulging in any activity which could
be damaging to our brand would be aptly prosecuted."
Expressing
his thoughts on the subject, India's leading intellectual property
legal expert and
..
..to the house of Valaya, Mr.
Praveen Anand (please substantiate the designation) said,
"
